TEMPORARY FENCE RENTAL - TERMS & CONDITIONS

1. INTRODUCTION

By renting temporary fence systems from RENT A FENCE (“Company”, “We”, “Us”, “Our”), all customers (“Customer”, “You”, “Your”) agree to the following terms and conditions. These terms apply to all rental transactions and services provided by the Company, including but not limited to delivery, installation, rental periods, and removal of fencing equipment. Acceptance of these terms occurs when the Customer places an order, makes payment, or accepts delivery of the rental equipment.

2. RENTAL EQUIPMENT AND SERVICES

The Company provides temporary fencing solutions for various purposes, including but not limited to construction sites, home renovations, event venues, and security needs. The rental includes the provision of the following:

  • Fencing Panels: 6’ x 10’ High-visibility red temporary fence panels (galvanized)
  • Additional Equipment: [Privacy Screening, Gate wheels, Sandbags, Signage etc.]
  • Delivery, Installation, and Removal: The Company will deliver, install, and remove the fencing as part of the rental service.

3. RENTAL PERIOD

  • Start Date: The rental period begins on the date of delivery and installation of the temporary fence.
  • End Date: The rental period ends on the date the fence is removed. If the Customer requires additional time beyond the agreed rental period, they must notify the Company in advance to arrange for an extension, which may incur additional fees.

Rental periods are typically billed on a 28-day basis, as specified in the rental order. The Customer agrees to pay for the full rental period, regardless of the actual usage.

4. RENTAL FEES AND PAYMENT TERMS

  • Rental Fees: The Customer agrees to pay the Company the total rental fee for the period of use. The rental fees may include the following charges: 
    • Base rental fee
    • Delivery and installation fee
    • Pickup and removal fee
    • Additional charges [Late fees, damage costs, etc.]
  • Payment: Payment is due in full before delivery and installation of the fence. The Customer may pay via [Credit Card, E-transfer, Bank Transfer, Cheque, etc.]. If payment is not received in full before installation, the Company reserves the right to delay or refuse service.
  • Late Fees: A late fee of [25%] will be applied for overdue payments.

5. DELIVERY, INSTALLATION, AND REMOVAL

  • Delivery and Installation: The Company will deliver and install the fencing at the designated location specified by the Customer. The Customer is responsible for ensuring that the installation site is accessible and free from obstructions. The Customer will notify the Company of any potential access issues prior to the scheduled delivery date.
  • Removal: The Company will remove the fence at the end of the rental period or upon request for early termination. If the Customer requires an extension, they must notify the Company in advance. Failure to arrange for removal may result in additional rental charges.
  • Site Conditions: The Customer is responsible for ensuring that the site is suitable for fence installation, including having a level, stable surface. If additional preparation is required to install the fence (e.g., clearing debris or making the site accessible), the Customer may incur additional charges.

6. CUSTOMER RESPONSIBILITIES

  • Proper Use: The Customer agrees to use the temporary fence in a safe and lawful manner and for its intended purpose. The fence should not be moved, altered, or tampered with by the Customer. Unauthorized changes may incur additional charges.
  • Maintenance and Care: The Customer is responsible for maintaining the fence in good condition throughout the rental period. If the fence is damaged due to misuse, vandalism, or neglect, the Customer will be charged for repair or replacement costs.
  • Damage or Loss: The Customer agrees to immediately notify the Company of any damage, theft, or loss of the rented fence. The Customer will be held liable for the repair or replacement costs of any damaged or lost equipment.
  • Safety: The Customer agrees to take all necessary precautions to ensure the safety of persons and property in proximity to the fence. The Company is not responsible for accidents, injuries, or property damage that result from the Customer’s use of the rented fence.

7. LIABILITY AND INSURANCE

  • Indemnity: The Customer agrees to indemnify and hold the Company harmless from any claims, damages, losses, or expenses arising from the use of the rented fence, including but not limited to accidents, injuries, or property damage.
  • Insurance: The Customer is encouraged to secure appropriate insurance coverage to protect against damage, loss, or liability arising from the use of the fence. The Company does not provide insurance for the Customer’s property or individuals.
  • Limitation of Liability: The Company’s liability for any claims related to this rental agreement shall be limited to the total rental fees paid by the Customer for the rental period, excluding any additional fees or charges.

8. CANCELLATION AND CHANGES

  • Cancellation Policy: The Customer may cancel the rental agreement at least [5 days] in advance of the scheduled delivery. Cancellations made within [5 days] of the scheduled delivery will incur a cancellation fee of [25%] of the total rental cost.
  • Changes to the Rental: If the Customer wishes to modify the rental terms (e.g., rental duration, equipment specifications, delivery date), they must notify the Company at least [5 days] in advance. Changes may result in additional charges based on the modifications.

9. FORCE MAJEURE

The Company will not be held liable for failure to perform under this Agreement due to events beyond its reasonable control, including but not limited to acts of God, natural disasters, strikes, labor disputes, government restrictions, or other unforeseen circumstances.

10. TERMINATION

  • Breach of Agreement: Either party may terminate this Agreement if the other party breaches any term or condition of this Agreement and fails to remedy the breach within a reasonable time (typically [7] days) after receiving written notice.
  • Early Termination by Customer: If the Customer wishes to terminate the rental before the end of the rental period, they must notify the Company in advance. The Customer will still be responsible for payment for the full rental period.

11. GOVERNING LAW

This Agreement shall be governed by and construed in accordance with the laws of the Province of Ontario, Canada. Any disputes related to this Agreement will be resolved under the jurisdiction of the courts in Ontario.

12. ACKNOWLEDGMENT AND ACCEPTANCE

By placing an order, requesting services, or accepting delivery of the rented fence equipment, the Customer acknowledges that they have read, understood, and agreed to the terms and conditions outlined in this Rental Agreement.
